These Terms and Conditions ("Terms") govern your use of the Hidayah Chambers website at hidayahc.live (the "Site") and, together with any engagement letter or retainer agreement, the provision of legal services by Hidayah Chambers ("the Chambers", "we", "us").

By accessing the Site or instructing us to act on your behalf, you acknowledge that you have read and understood these Terms. If you do not accept these Terms, please refrain from using the Site or engaging our services.

1. Information on This Site

The content published on this Site is provided for general informational purposes only. It does not constitute legal advice and should not be relied upon as such. Syariah family law in Malaysia is governed by state-specific enactments and administered by state Syariah courts; the applicable rules differ between the Federal Territory, Selangor, and other states. Any information on this Site is of a general nature and may not reflect the law applicable to your particular situation or jurisdiction.

Reading this Site, submitting an enquiry, or otherwise communicating with us does not create a solicitor-client relationship. A solicitor-client relationship is formed only upon execution of a written retainer agreement or engagement letter signed by a principal of the Chambers.

2. No Guarantee of Outcome

Nothing on this Site, in our marketing materials, or in any preliminary communication should be construed as a representation or assurance regarding the outcome of any legal matter. The conduct of Syariah court proceedings involves legal, factual, and procedural variables that lie outside our control. We will advise you candidly on the relative strength of your position, but we do not predict or warrant results.

3. Engagement of Services

3.1 Retainer Agreement

The engagement of Hidayah Chambers to act in any legal matter is subject to a written retainer agreement that sets out the scope of work, fee arrangements, billing practices, and other terms specific to the engagement. These Terms are supplementary to, and do not override, the terms of any retainer agreement you sign.

3.2 Fee Estimates

Any fee information on this Site (including the service prices listed) represents a starting point or indicative range for the stated service scope. Actual fees for your matter will be confirmed in your retainer agreement. Additional disbursements — including court filing fees, service fees, and document preparation costs — may apply and will be communicated to you transparently before they are incurred.

3.3 Conflict of Interest

Before accepting an instruction, the Chambers will conduct a conflict-of-interest check. We are unable to act for you if doing so would create a conflict with an existing client. If such a situation arises, we will inform you promptly and, where appropriate, suggest alternative counsel.

3.4 Client Obligations

You agree to provide us with complete and accurate information about your matter. Withholding material facts or providing misleading information may affect our ability to advise you and may result in termination of the retainer. You also agree to respond to our requests for instructions within a reasonable time and to cooperate with us in the conduct of your matter.

4. Confidentiality and Legal Professional Privilege

Communications between a client and their legal adviser in the course of an engagement are protected by legal professional privilege under Malaysian law. We treat all client information with strict confidentiality. However, we note that communications made via our website enquiry form or general email — prior to the execution of a retainer agreement — may not carry the same protection as communications made within a formal retainer. We recommend that sensitive details be shared only after a retainer has been established.

5. Intellectual Property

All text, graphics, layout, and other content published on this Site are the intellectual property of Hidayah Chambers or its content licensors. You may read and print content from this Site for your personal, non-commercial use. You may not reproduce, redistribute, adapt, or create derivative works from any content on this Site without our prior written consent.

The name "Hidayah Chambers" and the Chambers' logo and wordmarks are trade identifiers of the Chambers. They may not be used without our consent.

6. Acceptable Use of the Site

You agree to use this Site only for lawful purposes. You must not:

  • Use the Site in any way that breaches applicable Malaysian or international law.
  • Attempt to gain unauthorised access to any part of the Site or its underlying systems.
  • Transmit to the Site any material that is harmful, offensive, or contains viruses or other malicious code.
  • Use the Site to submit false enquiries or to impersonate another person.
  • Systematically extract or scrape content from the Site by automated means.

7. Third-Party Links

This Site may contain links to external websites for your convenience — for example, the e-Syariah portal or government resources. We do not endorse, control, or accept responsibility for the content of any linked external site. Accessing a linked site is at your own discretion and risk.

8. Limitation of Liability

To the maximum extent permitted by Malaysian law, Hidayah Chambers, its principals, employees, and associates exclude all liability — whether in contract, tort, or otherwise — for any loss or damage arising from:

  • Reliance on any information published on this Site without first seeking specific professional advice.
  • Interruptions to, errors in, or unavailability of this Site.
  • Unauthorised access to or alteration of your transmissions to this Site.

Nothing in these Terms limits or excludes our liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law. Our liability in connection with the provision of legal services under a retainer agreement is governed by the terms of that agreement and applicable professional regulations.

Your use of this Site is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. Please read those documents carefully.

10. Governing Law and Jurisdiction

These Terms and any dispute arising from your use of this Site are governed by the laws of Malaysia. The parties submit to the non-exclusive jurisdiction of the civil courts of Malaysia for the resolution of any dispute relating to these Terms. Where a dispute concerns a matter that falls within the exclusive jurisdiction of the Syariah courts, the applicable Syariah court shall have jurisdiction.

11. Amendments

We may update these Terms at any time. The revised version will be published on this page with an updated effective date. Continued use of the Site after the posting of revised Terms constitutes acceptance of those Terms. We encourage you to review this page from time to time.
