Which Syariah court has jurisdiction over my matter?
Jurisdiction follows your domicile and the domicile of the respondent at the time the application is filed. The Federal Territory Syariah Courts handle matters for residents of Kuala Lumpur, Putrajaya, and Labuan. Selangor residents fall under the Selangor Syariah Courts, and each other state has its own enactment. Where parties are in different states, we advise on the appropriate forum at your initial assessment.
What is the difference between fasakh, talaq, and khuluk?
Talaq is a pronouncement of divorce by the husband, which is registered at the Syariah court. Khuluk is a form of divorce initiated by the wife, typically involving a return of the dowry (mahr) as consideration. Fasakh is a court-ordered dissolution sought by the wife on grounds specified under the applicable enactment — such as failure to maintain, cruelty, or prolonged absence. The appropriate route depends on your circumstances, which we assess at the first session.
How is nafkah (maintenance) calculated?
Nafkah is assessed by the court based on the husband's means and the wife and children's reasonable needs. There is no fixed formula under the enactments, but courts consider salary evidence, living costs, and the standard of living maintained during the marriage. We assist in preparing the appropriate financial disclosure and in presenting a well-supported claim or defence.
What does a faraid distribution involve, and when is a court order needed?
Faraid governs the shares of Muslim heirs according to Islamic inheritance law. The practical steps depend on the asset types. Land transfers require a faraid certificate from the Syariah court; banking and unit trust assets are often dealt with through Amanah Raya for smaller estates; larger or more complex estates may require a High Court grant of probate. We map the full asset picture at the outset and recommend the most orderly path forward.
How long does a Syariah family proceeding typically take?
Timelines vary considerably. An uncontested talaq registration can be completed within weeks. A contested fasakh or hadhanah matter before the Lower Syariah Court may take six to eighteen months depending on the complexity and the court's schedule. Sulh is typically scheduled within the first two to three months of filing, and a number of matters do settle at that stage. We set realistic expectations at your assessment session.
Is the initial consultation confidential?
Yes, fully. The session is covered by legal professional privilege. Nothing you share is disclosed to any third party, including the other party in your matter. You are welcome to attend alone. We do not record the session, and you are under no obligation to proceed further after receiving your written options summary.
